Gigs App - Terms of use

Last updated: 8 December 2025These Terms of Use (“Terms”) govern your access to and use of the Gigs mobile application, website, and related services (collectively, the “App” or “Platform”), operated by Gigs App (“Gigs”, “we”, “us”, or “our”).By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not use the App.1. Overview of the Gigs AppGigs is a marketplace Platform that connects people who want to book services (“Buyers”) with independent service providers (“Sellers”) in South Africa.We do not employ Sellers. They are independent contractors, not our employees, partners, or agents.No digital/online services are supported at this time. All services are in-person, and Sellers are responsible for fulfilling services at the location specified by the Buyer.The App currently focuses on the following service categories only:• Photography
• Female Beauty
• Male Grooming
Any service that does not fall within these categories is not allowed on Gigs.2. Eligibility and Accounts
2.1 Age requirements
You must be at least 13 years old to create and use an account on the App (whether as a Buyer or Seller).If you are under 18, you confirm that you have obtained permission from a parent or legal guardian, and that they accept these Terms on your behalf.By using the App, you represent and warrant that:• You are at least 13 years old; and
• You have the right, authority, and capacity to agree to and comply with these Terms.
2.2 Account registrationTo use certain features of the App, you must create an account and provide accurate, current information. You agree to:• Keep your login credentials secure and confidential.
• Not share your account with others or allow others to use your account.
• Promptly update your information if it changes.
You are responsible for all activities that occur under your account.3. Role of Gigs App
3.1 Marketplace only
Gigs provides a platform where Buyers and Sellers can find each other, communicate, and arrange bookings and payments.We do not provide or perform the actual services listed on the App.Sellers are solely responsible for the services they offer and provide.Buyers are solely responsible for choosing Sellers and for any arrangements made with them.Any agreement for services is directly between the Buyer and the Seller, not between the user and Gigs.3.2 No employment relationshipNothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Gigs and any user. Sellers act as independent contractors and are fully responsible for complying with all applicable laws, including tax obligations.4. Permitted and Prohibited Services
4.1 Allowed categories (for now)
The Platform is currently limited to the following categories:• Photography
• Female Beauty
• Male Grooming
Sellers must only offer services that clearly fall within these categories.4.2 Prohibited servicesThe following are strictly prohibited on Gigs:• Adult content or adult services of any kind.
• Illegal services or services that facilitate illegal activity.
• Services related to drugs, weapons, or gambling.
• Any service that does not fall within the allowed categories specified above.
• Any service that violates applicable laws or regulations in South Africa.
We may remove any service, profile, or content that we believe falls outside these categories or appears unsafe, illegal, or otherwise inappropriate.5. User Conduct and Community RulesYou agree not to:• Harass, abuse, threaten, or intimidate any person.
• Engage in hate speech or discrimination based on race, gender, religion, nationality, disability, or any other protected characteristic.
• Engage in fraud, scams, or deceptive behaviour, including:
– Fake bookings
– Misleading profiles or gig descriptions
– Misrepresenting your skills, qualifications, or identity
• Offer or request illegal services or use the Platform for any unlawful purpose.
• Post or share any content that is:
– False or misleading
– Illegal or harmful
– Violent, obscene, or offensive
• Interfere with the operation of the App, including:
– Hacking, attempting to gain unauthorised access
– Using bots, scrapers, or other automated tools without permission
– Introducing malware or harmful code
Any behaviour that does not align with these Terms may result in suspension or termination of your account at our discretion.6. Content and Intellectual Property
6.1 Your content
Users may upload or submit content, including:• Profile information and photos
• Gig descriptions and pricing
• Reviews and ratings
• Messages and other materials
You remain the owner of your content, but by posting it on the App you grant Gigs a non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to:Use, display, host, store, reproduce, modify, and distribute your content in connection with operating, promoting, and improving the Platform (for example, showing your gig in search results, marketing sections, or “featured” listings).You represent and warrant that:• You have all necessary rights to the content you upload.
• Your content does not infringe any third-party rights or violate any laws.
6.2 Our contentThe App and all related content, including logos, branding, design, and software, are owned by or licensed to Gigs and are protected by intellectual property laws. You may not:Copy, modify, distribute, or create derivative works based on the App or its content, except as allowed by these Terms or with our prior written permission.7. Bookings, Payments and Fees
7.1 Booking process
Buyers can browse services and submit booking requests to Sellers. A booking is considered confirmed when:• The Buyer has submitted a booking request; and
• The Seller has accepted the request through the App.
Sellers are responsible for fulfilling accepted bookings at the location specified by the Buyer.7.2 Payment methodsGigs currently supports:• Cash payments, made directly between the Buyer and Seller at the time of service; and
• Card payments, processed through a third-party payment provider, currently Paystack.
Card payments are processed by Paystack (or any future payment partner), not by Gigs directly.7.3 Platform and transaction feesTransaction fees charged by Paystack are paid by the Seller and are deducted from the amount paid by the Buyer.Gigs may also charge service or platform fees to Sellers, which will be clearly disclosed in the App (for example, as a percentage of the booking or as fixed fees).Any applicable fees will be shown to Sellers before they accept a booking.7.4 Cancellations and refundsBuyers may cancel a booking at any time, except when:• The service is already in progress; or
• The service has already been fulfilled/completed.
Sellers may cancel a booking at any time, but repeated or abusive cancellations may lead to suspension or termination of their account.Gigs does not handle refunds.Any refunds or compensation (for example, if a service is not delivered or not as described) are strictly a matter between the Buyer and the Seller.Gigs is not responsible for issuing or enforcing refunds.Because Gigs is not a party to the contract between Buyer and Seller, we have no obligation to resolve financial or service-related disputes.8. Disputes Between UsersAt this stage, Gigs does not have the capacity to actively manage or resolve disputes between Buyers and Sellers.If a problem arises (e.g., quality of service, no-shows, late arrivals, disagreements), the Buyer and Seller must resolve it directly.Gigs may, at its sole discretion, review certain cases or take action on accounts (e.g., suspension or ban), but we are not obligated to get involved or to reach any particular outcome.You acknowledge and agree that:• Gigs is not a party to the agreement between Buyers and Sellers.
• Gigs is not responsible for any disputes, claims, or damages arising from interactions between users.
9. Safety, Background Checks and Assumption of Risk
9.1 No background checks (for now)
Gigs does not currently perform background checks or verify the professional qualifications, criminal record, or identity of Sellers beyond basic account information.9.2 Your responsibility and riskBecause services happen in-person and often in private or semi-private locations:You understand and agree that meeting or allowing someone to your location carries risk.You are fully responsible for your own safety, including:• Choosing where to meet
• Who you choose to work with
• Any precautions you decide to take
Gigs does not guarantee:• The safety, identity, skills, qualifications, or behaviour of any user.
• The accuracy or reliability of any profile, listing, rating, or review.
By using the App, you assume all risks associated with interacting with other users and receiving or providing services.10. Beta Status and Changes to the AppThe Gigs App is currently in an early/beta stage. This means:• Features, design, and functionality may change frequently.
• The App may contain bugs, errors, or interruptions.
• Some features may be launched, modified, or removed without prior notice.
We may update, suspend, or discontinue any part of the App at any time.11. Third-Party Services and LinksThe App may use or integrate with third-party services, including:• Payment providers (e.g. Paystack)
• Map and location services (e.g. Google Maps)
• Push notification providers
• Analytics providers
• Hosting, authentication, and other infrastructure services
Your use of these services may be subject to additional terms and privacy policies of those third parties. Gigs is not responsible for the content, terms, or policies of third-party services.12. Account Suspension and TerminationWe may suspend or terminate your access to the App, with or without notice, if:• You violate these Terms or any policies referenced in them.
• You engage in any behaviour that we consider harmful, unsafe, fraudulent, abusive, or misleading.
• You repeatedly cancel bookings in bad faith or are frequently reported by other users.
• We believe your continued use of the App creates risk for Gigs or other users.
You may stop using the App and request account deletion at any time (subject to any legal or legitimate business need for us to retain certain data, as explained in the Privacy Policy).Termination of your account does not remove your responsibility for obligations that arose before termination (for example, unpaid fees or legal obligations).13. Disclaimer of WarrantiesTo the fullest extent permitted by law:• The App and all content and services are provided on an “as is” and “as available” basis.We do not warrant that:• The App will be uninterrupted, secure, or error-free.
• Any information or content on the App is accurate, complete, or up to date.
• Any particular service outcome or booking will meet your expectations.
Gigs makes no guarantees or warranties (express or implied) regarding:• The quality, safety, legality, or suitability of any Seller, Buyer, or service.
• Any interactions or communications between users.
You use the App at your own risk.14. Limitation of LiabilityTo the fullest extent permitted by South African law:Gigs and its directors, employees, and affiliates shall not be liable for:• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, business, data, or goodwill.
• Any personal injury, property damage, or other harm arising out of:
– Your use of the App
– Your interactions with other users
– Any in-person meetings or services arranged through the App.
To the extent we can be held liable, our total liability to you for any claim arising out of or relating to the App or these Terms will be limited to the total amount of fees (if any) you paid to Gigs through the App in the six (6) months immediately before the event giving rise to the claim.Some laws may not allow certain limitations of liability. In such cases, these limitations apply only to the extent allowed by law.15. IndemnityYou agree to indemnify and hold harmless Gigs and its directors, employees, and affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to:• Your use of the App;
• Your violation of these Terms;
• Your violation of any law or third-party right;
• Any service you provide or receive through the App.
16. Changes to These TermsWe may update or modify these Terms from time to time. When we do:• We will update the “Last updated” date at the top of this document; and
• We may provide notice within the App or by email where appropriate.
If you continue to use the App after the updated Terms become effective, you are deemed to have accepted the changes. If you do not agree with the new Terms, you must stop using the App and may request account deletion.17. Governing Law and Dispute ResolutionThese Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.You agree that:• Before taking any formal legal action, you will first contact us at [email protected] to attempt to resolve the issue informally.
• If we cannot resolve the dispute informally within a reasonable time, any dispute, claim, or controversy arising out of or related to these Terms or your use of the App shall be submitted to the courts of South Africa, with primary venue in or near Potchefstroom, North West Province, unless another venue is required by law.
18. MiscellaneousEntire Agreement: These Terms constitute the entire agreement between you and Gigs regarding the App.Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.No Waiver: Our failure to enforce any right or provision in these Terms shall not be considered a waiver of that right or provision.Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction, in connection with a merger, sale, or other corporate transaction.19.
